These Terms of Service ("Terms") are a binding agreement that governs your access to and use of the mobileapplication.ca website and any content, tools, or forms on it (the "Site"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site. If you are using the Site on behalf of an organization, you represent that you are authorized to bind that organization.

Eligibility

You must be at least the age of majority in your province, state, or country to use the Site or to submit an enquiry.

About our services

mobileapplication.ca is a mobile app development studio based in Toronto, Canada, operated by Four Cents. Information on this Site describes our services in general terms and is not an offer, warranty, or guarantee of any specific outcome, ranking, revenue, or result. Any project we take on is governed by a separate written agreement, and in the event of a conflict that signed agreement prevails over these Terms for the work it covers.

No professional advice

Content on the Site, including guides and blog posts, is provided for general information only. It is not legal, financial, security, or professional advice, may not be current or complete, and should not be relied upon for any specific decision. You are responsible for evaluating the information and for any actions you take based on it. Always test changes and back up your website before making them.

Quotes and estimates

Quotes, ranges, and timelines shown on the Site or provided through the contact form are non-binding estimates for discussion only. They become binding only when set out in a signed agreement that defines the scope, price, and schedule of the work.

Intellectual property

The content, design, code, text, graphics, and layout of this Site belong to mobileapplication.ca / Four Cents or our licensors and are protected by copyright and other laws. You may view and print pages for your own reference, but you may not copy, republish, scrape, resell, or create derivative works from the Site without our written permission. For client projects, ownership of deliverables is set out in the project agreement; our standard practice is that clients own the source code and designs we create for them on final payment.

Trademarks and non-affiliation

mobileapplication.ca is an independent mobile app development studio. We are not affiliated with, endorsed by, sponsored by, or officially connected to Apple Inc., Google LLC, or any other platform, framework, or software vendor referenced on this website.

"Apple", "App Store", "iOS", "Swift", and related marks are trademarks of Apple Inc. "Google", "Android", "Google Play", and "Kotlin" are trademarks of Google LLC (Kotlin is a trademark of the Kotlin Foundation). All other product names, logos, brands, and trademarks are the property of their respective owners. Any use of third-party names, trademarks, or logos is for identification and descriptive purposes only and does not imply any endorsement, affiliation, partnership, or sponsorship.

App store review, approval, and publishing decisions rest solely with Apple and Google, and any warranties or obligations relating to their platforms, SDKs, or software rest with those companies, not with mobileapplication.ca.

Your submissions

If you send us content through a form (for example, project details), you confirm you have the right to share it, and you grant us permission to use it for the purpose of responding to you and delivering our services. Do not submit anything unlawful, infringing, confidential to a third party without authority, or that contains malware.

Acceptable use

You agree not to misuse the Site, including by attempting to disrupt or gain unauthorized access to it, probing or scanning its security, submitting fraudulent or automated form entries, scraping or harvesting data, overloading the infrastructure, or using it to violate any law or the rights of others.

Third-party links and software

The Site and the services we discuss may reference or link to third-party websites, plugins, themes, hosting, and software that we do not control. We provide these for convenience only and are not responsible for their content, availability, security, licensing, or practices. Third-party software is governed by its own licenses and warranties (or lack of them), which rest with its authors, not with mobileapplication.ca.

Disclaimer of warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE OR ITS CONTENT IS ACCURATE, RELIABLE, SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, mobileapplication.ca, Four Cents, AND OUR OWNERS, DIRECTORS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

You agree to indemnify, defend, and hold harmless mobileapplication.ca, Four Cents, and our owners, directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected to your use of the Site, your submissions, or your breach of these Terms or of any law or third-party right.

Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages, hosting or third-party service failures, cyberattacks, natural events, or government action.

Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree that the courts located in Toronto, Ontario have exclusive jurisdiction, and you consent to venue there, except that either party may seek injunctive relief in any court of competent jurisdiction. Before starting any formal proceeding, you agree to first contact us and attempt to resolve the matter informally in good faith for at least thirty (30) days. To the extent permitted by law, any dispute will be resolved on an individual basis, and you waive any right to participate in a class or representative action.

General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor or affiliate. These Terms, together with any signed project agreement and our posted policies, are the entire agreement between us regarding the Site.

Suspension and termination

We may modify, suspend, or discontinue the Site (in whole or in part) at any time, and we may restrict or terminate your access if you breach these Terms, without liability to you.

Changes

We may update these Terms from time to time. The date at the top shows the latest revision, and continued use of the Site means you accept the current version.
